  • Portugal Golden Visa: Residency Period Start Clarification

    We are excited to bring to your attention a significant update regarding the submission date for residency applications. This development carries substantial implications for those aiming to apply for Portuguese citizenship after fulfilling the required residency period.

    We have received verbal confirmation from the immigration services in Porto, along with an official email confirmation from the Agência para a Imigração e Mobilidade da Administração (AIMA), specifically from the Unidade de Apoio às Autorizações de Residência para Investimento (UARI), the department responsible for processing Golden Visa residencies. Both sources have confirmed that the submission date for residency applications will be recognized as the date the application is submitted online.

    This clarification is crucial as it establishes the starting point of the five-year residency period necessary for citizenship eligibility. According to the updated guidelines, the date you submit your application online will be counted as the official start of your residency period.

    While this update simplifies the process and provides a clear benchmark for applicants to understand when their residency period officially begins, it is essential to note that the regulation concerning this clarification has yet to be published, even though the deadline for publication has already passed. We are closely monitoring this situation and will continue to provide updates as new information becomes available.

  • Quebec Sets Limit on Family Sponsorship Applications

    Quebec’s Ministère de l’Immigration, de la Francisation et de l’Intégration has imposed a cap on family sponsorship applications from June 26, 2024, to June 25, 2026.

    The cap limits applications to 13,000:

    • 10,400 for spouses, common-law partners, and dependent children aged 18+.
    • 2,600 for parents, grandparents, and other eligible relatives.

    Exemptions apply to:

    • Dependent minor children.
    • Minor children for adoption.
    • Orphaned minor children of siblings or grandchildren.
    • Dependent adult children with disabilities.

    Once the cap is reached, no further applications will be accepted, and non-exempt applications will be returned.

  • Mercan Group Announcement: Extension of Residency Titles Validity in Portugal

    We are pleased to inform you that the Portuguese Government has extended the validity of all residency titles until June 30th, 2025. This decision, made after the Council of Ministers’ meeting, is part of a broader Public Administration Reform and Migration Action Plan.

    Public Administration Reform

    This reform, set to be implemented over the next four years, focuses on:

    • Enhancing unity and effectiveness of administrative actions;
    • Promoting cost-efficiency through shared resources;
    • Encouraging innovation and specialization;
    • Improving organizational and operational models.

     Migration Action Plan

    The Migration Action Plan includes three key pillars:

    • Proactive Immigration Attraction: The Agency for Integration, Migrations, and Asylum (AIMA) will proactively attract immigrants.
    • Migration Observatory: Establishing the Migration Observatory to value migration data and insights.
    • Extension of Documents and Visas: Extending the validity of documents and visas related to staying in Portugal until June 30th, 2025.

    Additionally, a Task Force for the Recovery of Pending Processes at AIMA has been created. This task force, operating until June 2, 2025, will focus on analyzing and deciding on pending processes for the regularization of foreigners, with up to 300 personnel dedicated to administrative processing and applicant assistance.

    A momentous development has unfolded as the European Parliament greenlights fresh regulations designed to simplify legal migration within the European Union (EU). These regulations entail strict timelines for processing residence permit applications, slashing waiting periods to a maximum of 90 days. Such a streamlined approach is poised to compel EU member states to accelerate decision-making processes, curtailing bureaucratic bottlenecks for migrants.

  • Fresh regulations aimed at modernizing and streamlining immigration procedures

    The Portuguese Government has set forth a plan for 2024 to expedite and streamline immigration proceedings in Portugal. This initiative is evident in the revised regulatory decree altering the legal framework for Foreign Law in Portugal (Law no. 23/2007).

    Recent amendments to the law, integrated within the “Mais Habitação” program, have notably led to the restructuring of SEF – Serviço de Estrangeiros e Fronteiras, culminating in the establishment of the new agency AIMA – Agência para a Integração, Migrações e Asilo, I. P. Consequently, it has become imperative to consolidate these recent changes in the legislation.

    The primary objective is to modernize and simplify the administrative processes currently overseen by immigration authorities. This overhaul aims to equip the new agency, AIMA, with the necessary tools to assess and expedite cases more efficiently, reducing bureaucratic hurdles while upholding heightened security standards.

    These measures align with the Government’s stated objective for the new agency to address the prevailing backlog and delays in application reviews.

  • PUBLIC DISCUSSION | RECENT NEWS

    17 April 2023

    As announced on March 30th, 2023, in the press conference held by the PM, the Government has finally delivered to the Parliament the proposed amendments to the immigration law, which are part of the proposal +Habitação.

    The document submitted to the Parliament, which became available last night, has some interesting points. As expected, the Government maintained its position regarding the end of the Golden Visa program. However, there are a few substantial changes in the wording used compared to the initial version shared in the presentation on February 16th, 2023.  From IAS’s side, we believe it is worth taking note of the following points:

    i) RENEWALS AND CONVERSION INTO D2 RESIDENCY – In the first document presented by the Government, still in February, it was mentioned that the possibility of renewals for holders of investments in real estate options would be dependent on the rental of the property for housing purposes. However, this measure does not appear in the document presented to Parliament on April 14th. It is evident in the proposal that renewals will be admitted on the same terms as have been so far. Despite the mandatory conversion of the application into the Entrepreneurs Residency Permit (D2 visa), they will be granted an exception regarding the minimum mandatory stay in Portugal, namely the applicants will be asked for a minimum of 7 days in the first year of residency and 14 days in the subsequent periods of two years of residency. The minimum stay should be proved in the same way as it has been until the present date.

    ii) INCLUSION OF SUBMISSIONS AFTER FEBRUARY 16TH – Also, there is no mention of the potential retroactive effects previously announced. Not only for the already submitted applications since February 16th but also for all the applications submitted until the law proposed becomes into force. The measure applies not only to Investors but also to their relatives applying under family reunification. We believe that the Government took sense and dropped this measure after the massive public message, including the one from the President of the Republic, showing the unconstitutionality of such action.

    iii) PERMANENT RESIDENCY – Applicants can keep applying for permanent residence and keep their minimum stay in the same terms as predicted for the Golden Visa.

    IV) INVESTMENTS FOR CULTURAL MATTERS – Applications for Investments under artistic production, recovery, or maintenance of cultural heritage will still be admitted. Regarding this topic, it is possible that during the discussion in the Parliament, other investment options will also be included as still allowed.

    V) IMPLEMENTATION OF THE NEW LAW – According to the document presented, the law related to the end of the Golden Visa regime is predicted to be implemented the next day after publication. However, a notice period may be introduced to the proposal during Parliament discussions.

    Despite the intentions mentioned above, and as explained in our previous articles, we do not anticipate that there will be any discussions on this matter in Parliament before the beginning of May, taking into consideration the available agenda of the Parliament. Also, the entire Legislative process is expected to take a minimum of 2 months.

    In any case, and even with a fair proposal as the one presented, we will keep working in our Investor’s best interests, namely with the request for a transition period between the publishing of the law and implementation. Nonetheless, it is essential to mention that now is the moment to invest.

    As a final note, it is also of reference that the opposition party has already delivered to the Parliament a proposal for keeping the Golden Visa Regime in the Administrative Area of the Madeira Archipelago. Therefore, it is expected that the Azores Area will also request an exception.

  • GOLDEN VISA PROGRAM | INFORMATION ON COUNCIL OF MINISTERS

    Dear Investors and Partners,

    Following our previous communication on March 5th, Mercan Properties participated in the public hearing during the last weeks, alongside the municipalities and other entities, to portray the benefits of the ARI program and submitted its memorandum for public consultation as well as other developers, associations, law firms, lawmakers, political parties, and other relevant stakeholders contributed to the extensive public consultation.

    At the Meeting of the Council of Ministers held yesterday, the Prime Minister (PM) António Costa presented the PowerPoint version of the final proposal on housing reforms to the public that will be sent to the Parliament for debate.

    The PM mentioned that Portugal is and will continue to be open to foreign investment; however, the PM indicated that the proposal presented maintains the initial position about the GV program, namely its termination. However, the PM also said that “the end of the Gold Visas depends on the Parliament and the promulgation of the President of the Republic.”

    The current law continues in place, and the portal for the SEF portal submission of applications continues to be opened. Regarding the bill proposal, there were no references to special conditions for renewing permits based on real estate investment under the current draft presented, which was included in the initial draft. In any case, the Government kept in the proposal,  the issue of the retroactive effect of the law to be approved,  and announced that it intends to submit all existing applications under the general regime for authorization permits.

    Given that the proposal was not made available – only the PowerPoint document used in the presentation by PM, there is no way of determining precisely what the proposal entails. In any case, the Government has been evident in stating that this is an initial proposal and that in the Parliament, both in the general session´s discussions and within the respective specific committees, there will be the possibility to debate and, eventually, amend the proposed solutions.

    When questioned about the date of entering into force the amendments, the Prime Minister directed the topic to the Parliament´s agenda and procedures.

    Regarding the following steps, we believe the path ahead will be as follows:

    • Considering the discussion in the Parliament’s general session, followed by the analysis in the respective specific committee and the final vote, a minimum of two months may be needed to complete this step.
    • Finally, the law will be submitted to the President of the Republic, who has 20 days to ratify, veto, or send the document to the Constitutional Court.

    Moreover, we are focused on making every effort to engage the Portuguese government in fulfilling the commitments which concern the ARI Program.

    Mercan Properties can assess and reassure its investors, that numerous Members of the Parliament and Members of the Cabinet are in favor of several amendments to the proposal on housing reforms and that the President of the Portuguese Republic, Marcelo Rebelo de Sousa, has already announced he will follow closely all matters that can be invoked regarding the constitutionality of the proposal.

    Furthermore, we reinforce that the projects developed by Mercan Properties remain available for investments and that investor applications continue to be submitted at SEF without any changes to the standard golden visa process. We will continue to issue a side letter covering potential liabilities for the investor arising from the current legislative moment as a solid guarantee from Mercan Properties.

  • GOLDEN VISA PROGRAM | INFORMATION ON PRELIMINARY DRAFT PROPOSAL

    Dear Investors and Partners,

    Following the Meeting of the Council of Ministries and the announcement on February 16th, 2023, by the Prime Minister about the housing reforms in Portugal, Mercan Properties would like to inform its investors that the Government has introduced in the public consultation process in course, a draft of the preliminary proposal of law on the March 3rd, 2023. This public consultation process will continue until March 13th, 2023.

    As mentioned in our previous communication about this draft proposal, a public debate is currently taking place. Therefore, the draft presented on the March 3rd is simply stating what was announced at the press conference on the February 16th and does not include any amendments or alterations resulting from both the public hearing taking place, and the several contributions already made public by developers, associations, law firms, lawmakers, political parties, and other relevant stakeholders.

    In what concerns the ARI (Golden Visa) Program, this preliminary draft includes, as announced by the Prime Minister in its press conference, the revocation of the ARI program. This is one of the steps in the legislative process and there are others still to come. It is important to underline that this is a preliminary draft proposal and it does not have any legal value at this stage.

    After the public consultation ends on March 13th, the government will analyze the different contributions and, if the deadline announced by the Prime Minister is met, bring them to the final discussions within the government in the council of ministers on March 16th.

    Next Steps:

    • Following the Council of Ministers, the final proposal will be presented to the public and sent to be discussed in the Parliament, this is a process that is unlikely to start before the end of March.
    • Considering the discussion in the general session of the Parliament, followed by the analysis in the respective specific committee and the final vote, two months may be needed for this step to be completed.
    • Finally, the law will be submitted to the President of the Republic, who has 20 days to ratify or veto the document.

    The two most relevant points at this stage are:

    1. The coming into force of any potential amendments to the ARI program – namely its termination;
    2. The regime of the renewals of the residence permits.

    As it has been made public the solutions presented by the Prime Minister on these matters, do not fit within the regulation set forth by the Portuguese constitution. Furthermore, the proposal presented is unclear and does not cover all relevant situations, and fails to present any alternative to the current legal regime. As we see it, and as it has been transmitted by several prominent lawyers and law firms, the present draft does not comply with the necessary requirements to be presented to Parliament, approved, and subsequently published by the President. Therefore, it is our firm conviction that this will not be the final wording of the amendment to the ARI program regime.

    Nevertheless, with regards to the projects developed by Mercan Properties, as through our 34 years of history in the world, we are strong believers in walking the talk, and therefore we are issuing a side letter that is aimed to cover any potential liabilities for the investor arising from the current legislative moment.

    Moreover, we continue to, directly and through the associations we are members of, participate in the public hearing during the month of March, and alongside the municipalities, and other entities in an effort to portray the benefits of the program as well as the need to guarantee and safeguard an appropriate transition period for any amendments to come in place.

    Ultimately Mercan is entirely committed to doing everything in its power to engage the Portuguese government in fulfilling the commitments, and that is the underlining basis of the trust investors deposit in the ARI program.
